Georgia Department of Transportation filed a petition for a writ of certiorari to an order from the Court of Appeals of Georgia asking whether the lower court was authorized to affirm the judgment of a trial court concerning the taking of appellee property owners’ land on the condition that a portion of the verdict would have be written off and whether the jury instruction given on actual value was harmless error. In a personal injury action, Piney Grove Baptist Church, an unincorporated association, appealed the trial court’s denial of its motion for summary judgment against a member. The member had sued the church on the basis of premises liability and respondant superior, and the church, in turn, filed a motion for summary judgment, which was denied. The Court of Appeals of Georgia affirmed the denial of the Church’s motion for summary judgment.

Gwinnett County filed a petition to condemn a portion of real property. The holders of a right of first refusal to acquire the property challenged a judgment of the Superior Court of Gwinnett County, which determined that they were not entitled to be compensated for any taking. The Supreme Court of Georgia affirmed the trial court’s ruling.
