Georgia Department of Transportation filed a petition for a writ of certiorari to an order from the Court of Appeals of Georgia asking whether the lower court was authorized to affirm the judgment of a trial court concerning the taking of appellee property owners' land on the condition that a portion of the verdict would have be written off and whether the jury instruction given on actual value was harmless error. The Supreme Court of Georgia reversed the decision of the Court of Appeals of Georgia.
